Your clinic uses Nudge Care to organise and analyse the health information it holds about you, and has given you access to it. This page explains who does what with your information, and sets out the short terms that apply to your use of the portal.

Part 1 is information. There is nothing to agree to.
Part 2 is the short set of terms that applies when you use the portal.

Definitions

These terms mean the same thing everywhere in this document, in both Part 1 and Part 2. They are set out once here so that the rest stays short.

  • Nudge Care, we, us, our: Nudge Care Ltd, registered in England and Wales under company number 16418291, whose registered office is at 66 Paul Street, London EC2A 4NA, United Kingdom. We supply the software

  • clinic, practice: The healthcare provider that invited you and that holds your health record. Your clinic is a separate organisation from Nudge Care

  • controller: The organisation that decides why and how personal data is used, and is answerable for it. Rights requests go to the controller

  • processor: An organisation that handles personal data on a controller's instructions, and may not use it for its own purposes

  • you, your: You, the person your clinic has invited to see your own information

  • the portal: The Nudge Care software through which you see your information

  • your profile: Your Nudge Care account and your access to the portal

  • your health record: The record of your health information that your clinic holds and controls. Part of it is shown to you in the portal

  • serious fault: Something we do, or fail to do, deliberately, or a failure that disregards a risk so obvious that no careful provider would have missed it. An ordinary mistake, a slip or an error of judgement is not serious fault

  • personal data: Any information that identifies you, or that could be linked back to you

  • health data: Personal data about your health. The law calls this "special category" data and protects it more strictly


Where this document says we, it means Nudge Care and nobody else. Where it says your clinic, the responsibility described belongs to your clinic and not to us.

Part 1. How this works

Part 1. How this works

1.1 Your clinic decides. We do the processing.

1.1.1 Your clinic is the controller of your health record. They decide what is recorded about you, why, and how long it is kept. They are responsible for telling you how they use your information, you may ask them for their privacy notice for further details.

1.1.2 Nudge Care is their processor. We provide the software and we act on your clinic's instructions. We do not decide what happens to your health record, and we do not use it for our own purposes.

1.1.3 Your clinic has authorised us to give you access to your own information. That is the reason you have a profile: your clinic instructed us to make part of your health record visible to you in the portal. The access is your clinic's to grant, and your clinic's to withdraw.

1.2 Where your information is held

1.2.1 Your health record stays in the European Union, including the backups and the AI processing performed on it. Nothing about your record is sent to an outside AI service to be processed: the models that read it run inside our own environment in the EU, and although which models we use changes over time, where they run does not. Some of those models are built by other companies, but those companies do not receive your information and cannot use it. The only things that leave the EU are an email address when we send you an email, and a sign-in check if you choose to log in with Google or Apple, neither involves your health information.

Our Privacy Policy sets out the detail: which suppliers are involved, where each one operates, how the AI processing works, and how long things are kept.

1.3 What you see in the portal, and who is responsible for it

1.3.1 Your clinic decides what is shown to you. The portal displays what your clinic has chosen to make visible. It is not necessarily everything your clinic holds about you, and it is not a complete copy of your health record.


1.3.2 Your clinic is responsible for checking that the information is accurate.
Nudge Care organises and presents what is provided to us; it is your clinic that reviews the results, confirms they are correct, and decides what they mean for your care. If something in the portal looks wrong or out of date, tell your clinic, they can correct it, and we cannot.


1.3.3 What is shown relates mainly to your most recent analysis, and older information may also appear.
The portal is not a live feed. Results, documents and analysis from earlier sessions may remain visible alongside the latest, and something you can see may have been superseded by a more recent test or a clinical decision.

1.4 Please do not make decisions about your health from what you see here

1.4.1 The portal shows you information. It does not tell you what that information means for you.

  • Do not act on it on your own. Do not start, stop or change any treatment or medication, and do not decide whether or not to seek care, because of something you have seen in the portal. Speak to your clinic first.

  • A clinician checking something does not make it certain. Your clinic reviews what goes into your record, and that catches most errors. It does not catch all of them. Something can still be wrong, missing or out of date after it has been checked. Treat what you see as a reason to have a conversation, not as a conclusion you can rely on.

  • What your clinic tells you directly is the version that counts. A consultation, a call, a letter or a message from your clinic is the official communication about your care. If anything in the portal differs from that, or you are not sure, your clinic is right and the portal is not.

  • If something looks worrying or unexpected, contact your clinic. And do not let the portal reassure you either: if you feel unwell, get advice, whatever the portal shows. Nothing here is a check that you are well.

1.5 What we do not do with your information

1.5.1 Your information is not used to train AI models, not ours, and not those of the companies whose technology we use, who are contractually barred from training on it.

1.5.2 It is not used for anything other than providing the service to your clinic. We do not sell it, we do not advertise to you, and we do not share it with anyone except the suppliers listed in our Privacy Policy who help us run the service.


1.5.3.
If that ever changes, we will ask you first and you can say no. Any new use of your data would be opt-in: nothing happens unless you actively agree, and declining or ignoring the question, means your data is not used. It would never be switched on by default or applied to information we already hold.

1.6 How the portal itself is used

1.6.1. We collect information about how the portal is used. We use it to keep the portal working and to improve it, and we hold it separately from your health record. It is not used to make any decision about you, it does not form part of the record your clinic sees, and it is never used to build a profile of you or to market to you.

1.6.2. This is the one thing described on this page that we do for our own purposes rather than on your clinic's instructions, which is why it is set out separately. Our Privacy Policy covers it in full.

1.7 Ending your access

1.7.1 Ask your clinic and they will close your profile. Your clinic gave you this access in the first place, so it is your clinic that removes it. You do not have to explain why. You can also simply stop using the portal at any time.


1.7.2.
Please note what closing your profile does and does not do. It ends your access to the portal. Whether your health record is also deleted is a separate question, and also your clinic's decision, because your clinic may have professional or legal duties to keep health records for a period. Ask your clinic about any relevant topic.

1.8 If your clinic stops using Nudge Care

1.8.1 Your access ends when your clinic's arrangement with us ends. What happens to the information we hold for them is your clinic's decision, not ours: they can ask us to return it or to delete it, and if they tell us nothing, we delete it. Your clinic's own records are not affected, because those are held in their system and not by us. If you want a copy, ask your clinic before that point.

1.9 Your rights over your information

1.9.1. You have rights under data protection law to see your information, correct it, ask for it to be deleted, object to how it is used, and get a copy of it.


1.9.2 Your clinic is the controller of your information, so all of these requests go to your clinic. They hold the record, they decide what happens to it, and they are the party who can answer you. Nudge Care processes the information on your clinic's instructions and is not permitted to answer a request about it, or to confirm to anyone else that we hold information about you.


1.9.3 Getting a copy of your information. Ask your clinic. They hold the record and they can give you a copy of it. Your clinic can also tell you what information it holds about you and how long it keeps it.


1.9.4. You can complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113) if you are unhappy with how your information has been handled.

1.10 What Nudge Care is, and is not

1.10.1. Nudge Care organises and analyses health information for your clinic. It does not diagnose and it is not medical advice. Analysis you see in the portal may be incomplete or wrong, and is meant to be read together with your clinician, not instead of them. Please read §1.4, "Please do not make decisions about your health from what you see here", it is the most important part of this page.


1.10.2 You are not talking to an AI.
The portal shows you information. There is nothing in it for you to ask questions of, and nothing you type is answered by a machine. The analysis was produced before you saw it, and your clinic saw it first.

1.10.3 Automated analysis is not a decision about you. The portal produces results, trends and indications automatically. We do not make decisions about you by automated means alone, and nothing you see is a diagnosis. Your clinic reviews it before it is relied on (§1.3), and if you think something is wrong, ask your clinic to look at it again.

1.10.4 Nudge Care is not for emergencies and nobody at Nudge Care monitors your health record. If you think you are having a medical emergency, call the emergency telephone number (e.g. 999) or go to an emergency department. If you are in distress, contact your local crisis service; in the UK, the Samaritans on 116 123.

Part 2. Terms for using the portal

Part 2. Terms for using the portal

2.0.1 Parties. These terms are an agreement between you and Nudge Care. Your clinic is not a party to them.

2.0.2 Accepting them. By using the portal, you accept these terms. If you do not accept them, do not use it; you can ask your clinic to close your profile, and your care is unaffected either way.


2.0.3 Scope. These terms cover your use of the portal only. They do not change anything in Part 1, they do not create any agreement between you and your clinic, and they are not consent to the processing of your health data, that is a matter between you and your clinic.


2.1 Your access. We give you a personal, non-transferable right to use the portal to see and manage the part of your health record your clinic makes visible to you. Your access depends on your clinic's arrangement with us; if that ends, your access ends.


2.2 Your login. Keep it to yourself. Do not share your profile. Tell us at contact@nudge.care if you think someone else has access.


2.3 Accuracy. Information you add about yourself should be accurate as far as you know, because your clinicians may rely on it.


2.4 Who owns what, and what you may do with it.


2.4.1 The portal (the software, its design, and the way information is organised and presented) belongs to Nudge Care, or to those we license it from. Using it gives you the personal right in §2.1 and nothing more.


2.4.2 Your record belongs to your clinic, and the information in it is about you. You may read, download, save, print and share your own information freely**, and nothing here restricts that.


2.4.3 You may not copy, adapt, translate, reverse-engineer or republish the portal or any part of it, use it for anyone but yourself, try to reach anyone else's information, or extract data from it by automated means.


2.5 Age. You must be 18 or over to hold a portal account. Where the portal is used for someone under 18, your clinic arranges it and the account belongs to an adult with parental responsibility for them, not to the child. It is registered in that adult's name and to that adult's own email address, that adult accepts these terms, and that adult is responsible for how the account is used and for what is shared from it.


2.6 No charge. The portal is provided to you free of charge. Your clinic pays for the service.


2.7 Availability, and changes to the portal. We work to keep the portal running, but we do not promise it will always be available or free of faults. We may change it, add or remove features, or take it down for maintenance, and we will give notice of significant changes where we reasonably can. Access also depends on your clinic's arrangement with us (§2.1).


2.8 If the portal is misused. If your account is used in a way these terms do not allow, we may suspend or close it. Where it is reasonable to do so we will tell you first and give you a chance to put it right, and we will tell your clinic.


2.9 How we contact you. We write to the email address held on the account. Keep it current and tell your clinic if it changes, because notices we send to that address, including notice of a change to these terms, count as given even if you no longer read it.


2.10 What we are responsible for, and what we are not.


2.10.1 We are responsible to you only where loss is caused by our serious fault, as defined above. The portal is provided to you free of charge, and this reflects that.


2.10.2 We are never responsible for:

  • clinical decisions, advice or care given by your clinic or its clinicians;

  • the accuracy or completeness of your health record, or what your clinic chooses to show you;

  • what follows if you act on something you see in the portal without speaking to a clinician;

  • loss caused by information you gave us that was wrong or incomplete;

  • loss caused by your login being shared with, or used by, someone else;

  • the portal being unavailable, or your clinic ending your access;

  • loss of profit, business or opportunity, or any loss that was not reasonably foreseeable.


2.10.3 Where we are responsible, our total liability to you is limited to £100.


2.10.4 Nothing above limits our liability for:

  • death or personal injury caused by our negligence. This applies to any negligence on our part, including an ordinary mistake that would not count as serious fault;

  • fraud or fraudulent misrepresentation;

  • anything else the law does not allow us to limit.


2.10.5 Your rights as a consumer are unaffected, as is any claim you may have against your clinic.


2.11 Changes. If we change these terms in a way that matters, we will tell you at least 14 days beforehand and ask you to accept the new version. Keep a record of your terms if you need to.


2.12 If part of these terms does not hold. If any part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce something straight away, we have not given up the right to do so later. These terms are between you and us; nobody else has rights under
them.


2.13 Law. England and Wales, without affecting the protection of the mandatory laws of the country you live in.
